Starting to use the Website http://edu.sike.ruor clicking the button to confirm your agreement with the text of this Agreement when authorizing on the Website http://edu.sike.ru means your unconditional acceptance of the terms of this Agreement. If you do not agree with the terms of this Agreement, you must terminate the authorization and do not use the Website http://edu.sike.ru.

This Agreement on the online version use of SIKE E-courses, Online trainers and Simulators posted on the website http://edu.sike.ru (hereinafter also referred to as the "Agreement") concluded between:

persons who have accepted the terms of this Agreement in full by joining this Agreement (hereinafter - the "User"), on the other hand

1. Terms of the Agreement
Authorization - User's account activation by entering on the Website the login and password provided to the User by the Copyright Holder.
Website - the website of the Copyright Holder with the domain name http://edu.sike.ru.
Copyright Holder (the owner of the exclusive right to SIKE E-courses, Online trainers and Simulators posted on the Website) - LLC "Corporate Systems Plus".
SIKE E-courses, Online trainers and Simulators – the results of intellectual activity of the Copyright Holder, posted on the Website.
Tariff - the price of the service provision by the Copyright Holder with online access to SIKE E-courses, Online trainers and Simulators. The tariffs are brought to the User's attention by placing them at the following address: https://shop.sike.ru.
Account – login and password required to identify the User when providing online access to SIKE E-courses, Online trainers and Simulators on the Website. The account is created by the Copyright Holder and sent to the User's email address.

2. Subject of the Agreement
2.1. Under this Agreement the Copyright Holder provides the User with a online access service to the SIKE E-courses, Online trainers and Simulators posted on the Website, in accordance with the terms of this Agreement.
2.2. By this Agreement the Copyright Holder does not grant the User a license for the Copyright Holder's software. Licenses for the Copyright Holder's software are provided in accordance with other separate agreements, depending on the selected Tariff.
2.3. Under this Agreement the Copyright Holder does not provide educational services to the User under any circumstances.
2.4. This Agreement in accordance with clause 1 of Article 428 of the Civil Code of the Russian Federation is a form that determines the terms of the accession agreement.
2.5. The User's accession to this Agreement is carried out by User authorizing on the Website.
2.6. The Copyright Holder provides the User with online access to SIKE E-courses, Online trainers and Simulators posted on the Website within the period specified in the Tariff.
2.7. The Copyright Holder provides the User with trial online access to SIKE E-courses, Online trainers and Simulators posted on the Website for the period specified in an email from the Copyright Holder with an Account and/or an active Internet link to the Website.

3. Access and use of SIKE Electronic Courses, Online trainers and Simulators on the Website
3.1. In order to get online access to E-courses, Online Simulators and SIKE Simulators posted on the Website, the User must make a payment on the website https://shop.sike.ru in accordance with the selected Tariff. After payment the Copyright Holder sends an email with an Account detail and/or an active Internet link to the Website to the User's email address in accordance with the selected Tariff.
3.2. At the Copyright Holder discretion the User may be provided with trial online access to SIKE E-courses, Online trainers and Simulators posted on the Website within the period specified in clause 2.7. of this Agreement.
3.3. Technical requirements for the User's software and equipment for using the Website

3.3.1. For SIKE e-courses:

• Supported browsers for Mac:

o Google Chrome (latest version) for Apple iOS 12 or later
o Google Chrome (latest version) for Android OS 6 or later

3.3.2. For online versions of SIKE trainers and simulators 2.0:

• Operating System: Windows 7 (SP1) or later.
• Processor: x64 architecture with SSE2 support, 2 cores, 3.5 GHz.
• Video card: Memory capacity from 1024 Mb, memory interface from 128-bit GDDR5, compatible with DirectX 10 (shader model 4.0).
• RAM: 4096 Mb.
• Software: DirectX 10, updated graphics card driver.
• Web Browser: 64-bit version (Firefox 52+, Chrome 57+) and later.
• Network connection: Fast Ethernet 100 Mbit/s, or Wi-Fi up to 72 Mbit/s

3.4. By joining to this Agreement the User confirms that the User’s software and equipment for Website using complies with the technical requirements specified in clause 3.3 hereof.
3.5. Internet access for the Website usage is paid by the User
3.6. The User has the right to view SIKE E-courses, Online trainers and Simulators provided by the Copyright Holder with online access on the Website according to the Tariff paid by the User.
3.7. After providing the User with online access to the Website in accordance with the paid Tariff, the service is considered to be properly provided by the Copyright Holder in full, and the services cost for providing online access to SIKE E-courses, Online simulators and Simulators posted on the Website is non-refundable.
3.8. The User assures the Copyright Holder that the actions performed on the Website after the User's Authorization are recognized as the User own's actions
3.9. The User is obliged to maintain the login and password to the Account on the Website confidentiality.

3.10 User does not have the right permissions to:
3.10.1. reproduce, copy, process, distribute, make available to the public any materials and results of Copyright Holder intellectual activity posted on the Website.
3.10.2. get access to someone else's Account.
3.10.3. use any results of Copyright Holder intellectual activity posted on the Website (including trademarks and software).
3.10.4. delete or modify copyright notices posted on the Website.
3.10.5. provide the login and password to the Account to third parties.
3.10.6. disassemble, decompile the software of the Website (convert the object code into the original code) and modify the components of the software of the Website, including instructing other persons to perform these actions.
3.10.7. publish the materials and results of the Copyright Holder intellectual activity posted on the Website thereby giving other persons the opportunity to copy them.
3.10.8. assign the rights under this Agreement to any third parties.
3.10.9. perform other actions, the right to perform which is not expressly granted by this Agreement.

3.11 If the User purchases online access to the Website on base of Tariff for individuals then the User is obliged to use online access to the SIKE E-courses, Online trainers and Simulators posted on the Website exclusively for personal, family, home use purposes not related to business activities and only from premises that are not used for commercial purposes.
3.12. The Copyright Holder has the right to make changes to the Website at any time without User prior notice.

4.Tariffs
4.1. The Copyright Holder's services cost for providing the User with online access to SIKE E-courses, Online trainers and Simulators posted on the Website is set according to the Tariff on the website https://shop.sike.ru.
4.2. The User pays the cost of services according to the Tariff by non-cash payments. Non-cash payment can be made by bank transfer using a bank card, as well as by electronic payment in accordance with the procedure specified on the website https://shop.sike.ru.
4.3. All bank expenses for funds transferring to the Copyright Holder as a payment for the services under this Agreement are in charge of the User.

5.Personal User's Data
5.1. When making a purchase on the website https://shop.sike.ru and (or) https://elearningsike.com and/or authorization on the Website the User gives consent (hereinafter referred to as "Consent")

5.1.2. Consent is given by the User to the processing of personal data both without the use of automation tools and with their use.

During of the User's personal data processing the following actions will be performed: collection; recording; systematization; accumulation; storage; clarification (updating, modification); extraction; use; blocking; deletion; destruction. 5.1.5. Consent is valid from the date the User provides his personal data to the Copyright Holder by placing an order on the website https://shop.sike.ru and (or) https://elearningsike.com/ and clicking the button to confirm consent with the text of this Agreement on the Website until expiration of the storage time of the relevant information, determined in accordance with the legislation of the Russian Federation or until the day of withdrawal in writing.

6.Liability of the parties
6.1. Illegal use of the results of Copyright Holder intellectual activity posted on the Website is a violation of the legislation of the Russian Federation and is prosecuted by law. For violation of the intellectual rights of the Copyright Holder the violator bears civil, administrative or criminal liability in accordance with the legislation of the Russian Federation.
6.2. In case of detection of non-fulfillment or improper fulfillment of this Agreement by the User, the Copyright Holder has the right, without prior notice, to restrict the User's online access to SIKE E-courses, Online trainers and Simulators posted on the Website by blocking /deleting the User's Account.
6.3. The Copyright Holder is not responsible for User's direct and indirect losses, damages, harm, lost profits, loss of information, etc., which may arise as a result of using the Website.
6.4. The Copyright Holder is not responsible for non-fulfillment or improper fulfillment of its obligations under this Agreement in case the User does not have access to the Internet or in case the User does not have hardware-software recommended for the correct operation of SIKE E-courses, Online trainers and Simulators.
6.5. The Copyright Holder liability under this Agreement in any case is limited by the cost of services paid by the User according to the Tariff.

7. Period Of Validity Of The Agreement
7.1 This Agreement comes into effect from the moment when a User accedes to the Agreement and is valid during the services provision period, according to clause 2.6 and clause 2.7 hereof.

8. Applicable law and dispute resolution
8.1 This Agreement shall be regulated and interpreted according to laws of the Russian Federation.
8.2 If any provision of this Agreement is held to be canceled, invalid, unenforceable or illegal the remaining provisions of this Agreement will remain in full force and effect.
8.3 All disputes, controversies or claims arising out of this Agreement or concerning its violation, termination, invalidity, subordinated to the courts of general jurisdiction, are subject to resolution in the courts of Magnitogorsk with mandatory compliance with the pre-trial claim procedure in accordance with the current legislation of the Russian Federation. The term for claim responding is within 30 (thirty) working days following the date of receipt of the claim.
8.4. All disputes, controversies or claims arising out of this Agreement or concerning its violation, termination, invalidity, subordinated to the subordinated to arbitration courts, are subject to resolution in the Arbitration Court of the Chelyabinsk region with mandatory compliance with the pre-trial claim procedure in accordance with the current legislation of the Russian Federation. The term for claim responding is within 30 (thirty) working days following the date of receipt of the claim.
8.5 This Agreement is made in Russian and in English, in case of controversy between two language versions the Russian version shall prevail.

9.Changes to the Agreement
9.1 The Copyright holder has the right, unilaterally, to make any amendments and addenda to the Agreement.
9.2 Notification of any amendments (addenda) to this Agreement is carried out by the Copyright Holder by posting these amendments (addenda) on the website https://shop.sike.ru and on the Website.
9.3 All changes (additions) made by the Copyright Holder to this Agreement and not related to changes in the current legislation of the Russian Federation enter into force and become binding on Users after 5 (five) calendar days from the date of posting changes (additions) on the website https://shop.sike.ru and the Website.
9.4. The amendments (additions) to this Agreement that have entered into force apply equally to all Users who have joined the Agreement.
